Parties are encouraged to request loss mitigation as early in the case as possible, but loss mitigation may be initiated at any time. A separate Loss Mitigation Order must be submitted for each party listed in the Loss Mitigation Request.
Beginning in December 2024, the following new procedures will apply to loss mitigation status conferences: Initial status conferences will continue to be scheduled per the Loss Mitigation Order, but the Court will no longer automatically schedule further status conferences. Instead, either party may request a further status conference by filing a written request at least 7 days prior to a loss mitigation hearing date, detailing the status of the parties’ discussions and the reason for the requested conference. Following such a request, the other party is required to file a status report at least two days before the hearing date. If the Court schedules a status conference on its own initiative, rather than at the request of a party, both parties are required to file a status report at least two days before the hearing date.
