Rule 6007-1

ABANDONMENT OR DISPOSITION OF PROPERTY

  1. Unless the Court orders otherwise, the notice of a proposed abandonment or disposition of property pursuant to Bankruptcy Rule 6007(a) shall describe the property to be abandoned or disposed of, state concisely the reason for the proposed abandonment or disposition, and, in the caseof abandonment, identify the entity to whom the property is proposed to be abandoned.

  2. If the trustee files a notice of abandonment of a residential real property lease, other than a proprietary lease for a cooperative residence, the notice need only be served on the debtor and the landlord.

Comment

     This rule, added in 1996, simplifies the procedure for abandonment of an individual debtor's leased residence that is of no value to the estate so that the debtor may remain in such premises.
