Proposed Amendments to Local Bankruptcy Rules - comments due by 9/16/2024

The Local Rules Committee, the Business Bankruptcy Advisory Committee, and the Judges for the United States Bankruptcy Court for the Southern District of New York are proposing amendments to the Local Bankruptcy Rules and invite comments regarding the revisions. In connection with the proposed amendments to Rule 4001-2 of the Local Bankruptcy Rules, the Business Bankruptcy Advisory Committee has prepared an illustrative and non-binding model form of order for interim debtor-in-possession financing and cash collateral.

The redlined version of the proposed amendments along with a copy of the illustrative model order are available at: www.nysb.uscourts.gov,Proposed Local Rules and Orders,” and available here.  Please provide comments to localrules@nysb.uscourts.gov by no later than September 16, 2024.  Insert the phrase “Local Rules” in the subject line.

The proposed amendments will not become effective until adopted by the United States Bankruptcy Court for the Southern District of New York.
