CM/ECF Changes for Small Business Reorganization Act (SBRA)

Filers should be aware of the following changes in CM/ECF for the Small Business Reorganization Act (SBRA).



Case Opening
(Ch. 11 Cases):



 

 


When opening a Ch. 11 business case, filers will now receive three options to select from regarding the debtor's small business status.


  • No, I am not a small business debtor.

  • Yes, and I do not choose to proceed under Subchapter V of Chapter 11.

  • Yes, and I choose to proceed under Subchapter V of Chapter 11.

The selection on this screen shall correspond with the selection on the debtor’s petition (i.e., #13 on Official Form 101 and #8 on Official Form 201).


Debtor’s Election of Small Business Designation:


The docket event Bankruptcy Other Debtor’s Designation as Small Business Debtor shall be used to elect to proceed as a small business debtor and to elect whether to proceed under Subchapter V. 


Chapter 11 Subchapter V Pre-Status Conference Report


The status report mandated by 11 U.S.C. § 1188(c) shall be filed by the debtor using the docket event Bankruptcy Other Chapter 11 Subchapter V Pre-Status Conference Report.


Chapter 11 Small Business Plan:


The event code Bankruptcy Plan Chapter 11 Small Business Plan has been modified to allow the docketing of the Small Business Plan in a Subchapter V case.


Notice of Appointment of Trustee in Chapter 11 Subchapter V Case


The event code Bankruptcy Trustee/US Trustee Notice, Appointment of Trustee in a Chapter 11 Subchapter V Case will be used by the Office of the United States Trustee to enter the appointment of the Trustee.
