Changes to the Federal Rules of Bankruptcy Procedure and Forms

Effective December 1, 2024

 

On December 1, 2024, the following Federal Rules of Bankruptcy Procedure, Official Bankruptcy Forms and Director’s Forms will be amended:

  • Bankruptcy Rules Parts I through IX have been restyled
  • Bankruptcy Rules 1007, 4004, 5009, and 9006 have been amended to require an individual debtor to file a certificate of course completion in lieu of Official Form 423
  • Bankruptcy Rule 7001 has been amended to create an exception for certain turnover proceedings under § 542(a) of the Code
  • New Bankruptcy Rule 8023.1 Substitution of Parties
  • Official Form 410 Proof of Claim
  • Director’s Form 1040 Adversary Proceeding Cover Sheet
  • Director’s Form 2000 Required Lists, Schedules, Statements, and Fees
  • Director’s Form 2630 Bill of Costs

Please note that Official Form 423 Certification About A Financial Management Course will be abrogated due to the amendment to Rule 1007.  Rule 1007(b)(7) will require an individual debtor to file the certificate of course completion concerning personal financial management, if the provider has not already notified the court that the debtor has completed the course.  Effective December 1, 2024, the certificate of course completion must be filed in lieu of Official Form 423.  Therefore, all docketing events relating to Official Form 423 will be deactivated.
